Terms of Service

These Terms of Service ("Terms") apply to your use of sellmypropertypronto.com (the "Site") and to any information you submit through it. By using the Site or submitting your information, you agree to these Terms. If you do not agree, please do not use the Site.

1. Three Separate Companies

Three separate and independent companies are involved with this Site. Each has its own role, and no one company is responsible for the acts of the others.

No partnership, joint venture, or agency relationship exists between you and any of these companies just because you used the Site or submitted information.

2. No Offer Until It Is in Writing

• Submitting a form, receiving a call or text, or getting a price estimate is not an offer and does not create a contract.
• A purchase happens only if you and Jerari Group LLC both sign a written purchase agreement. That agreement, not these Terms, will control the sale.
• Jerari Group LLC may decline to make an offer on any property for any lawful reason.
• You are never required to accept an offer.

3. Buyer Is Not Your Agent

Because Jerari Group LLC is buying for itself, its interests are different from yours. It is trying to buy at a price that works for it. Jerari Group LLC does not owe you the duties a broker owes a client. If any real estate licensee has an ownership interest in Jerari Group LLC, that interest will be disclosed to you in writing before you sign a purchase agreement, as required by law.

You have the right to hire your own real estate agent, attorney, appraiser, or tax advisor before you sign anything. We encourage you to do so.

4. Brokerage Services

If your property is not a fit for Jerari Group LLC, you may be offered the option to list your property for sale with Romewest Properties, or to be referred to a licensed broker in your state. Any listing or representation requires a separate written agreement that explains the services and fees. Romewest Properties may receive a referral fee from another broker, and this will be disclosed to you as required by law.

5. Your Information

How your information is collected, used, and shared is explained in our Privacy Policy, which is part of these Terms. By submitting information, you confirm that:

• The information is true and accurate to the best of your knowledge
• You are at least 18 years old
• You are the owner of the property, or you are authorized by the owner to share its information

6. Calls, Texts, and Emails

Text messages (SMS program terms).

• Program name and sender: Sell My Property Pronto, operated by RTCS Digital, a d/b/a of Rture Collective Solutions LLC.
• What you will receive: If you check the property text-message box, you will receive texts about your property inquiry, such as offers, appointment reminders, and follow-ups. If you also check the optional marketing box, you may receive occasional texts about our cash offer programs.
• Frequency and cost: Message frequency varies. Message and data rates may apply.
• Opt out: Reply STOP at any time to stop all texts. You will receive one final message confirming you have been unsubscribed.
• Help: Reply HELP for help, or call 915-307-4888.
• Not required: Consent to receive texts is not a condition of selling your property or receiving an offer.
• Carriers: Mobile carriers are not liable for delayed or undelivered messages.
• Privacy: Your text-message opt-in data and consent are not shared with any third party. See our Privacy Policy.

Calls and emails. By submitting your information, you agree that RTCS Digital, Jerari Group LLC, and Romewest Properties may call or email you about your property inquiry. You may ask any of them to stop at any time.

7. No Professional Advice

Content on the Site, and anything said in calls, texts, or emails, is general information only. It is not legal, tax, financial, or appraisal advice. Any price, value, or estimate shared before a written purchase agreement is not an appraisal and is not a promise.

8. Acceptable Use

You agree not to:

• Submit false information or information about property you have no right to sell
• Use the Site for anything illegal or fraudulent
• Try to hack, overload, scrape, or interfere with the Site
• Copy or reuse the Site's content, design, or branding without written permission

9. Site Content and Availability

All content on the Site belongs to its owners and is protected by law. The Site is provided "as is" and "as available." We may change, pause, or remove any part of the Site at any time without notice.

10. Disclaimer of Warranties

To the fullest extent allowed by law, the Site and its content are provided without warranties of any kind, whether express or implied, including warranties of accuracy, merchantability, fitness for a particular purpose, and non-infringement.

11. Limitation of Liability

To the fullest extent allowed by law, RTCS Digital, Jerari Group LLC, and Romewest Properties, and their owners, employees, and agents, will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Site. Each company is responsible only for its own acts and not for the acts of the others. Nothing in these Terms limits any rights you have under a signed purchase agreement, a signed brokerage agreement, or laws that cannot be waived.

12. Indemnity

You agree to cover any claims, losses, or costs (including reasonable attorney's fees) that result from false information you submit or from your violation of these Terms.

13. Governing Law

These Terms are governed by the laws of the State of Texas. Any dispute about these Terms or the Site will be handled in the state or federal courts located in El Paso County, Texas, unless the law of the state where your property is located requires otherwise.

14. Changes to These Terms

We may update these Terms from time to time. When we do, we will change the "Last updated" date at the top of this page. Your continued use of the Site after a change means you accept the updated Terms.

15. General

If any part of these Terms is found unenforceable, the rest stays in effect. If we do not enforce a part of these Terms, that does not waive our right to enforce it later. These Terms and the Privacy Policy are the full agreement about your use of the Site.
